By using the Services, you consent to the data practices described in our Privacy Policy. Where you are located in India, we process personal data in accordance with the Digital Personal Data Protection Act, 2023, and applicable rules issued thereunder.

You must be at least 18 years old and capable of forming a legally binding contract to use the Services. HomeThingy is operated from India. We make no representation that the Services, or the accuracy of Reports, are appropriate or available for use in every location. If you access the Services from outside India, you do so on your own initiative and are responsible for compliance with local laws, including data transfer and import/export regulations.

HomeThingy uses artificial intelligence and machine learning to analyze publicly available data — including public records, census data, listing databases, and crime statistics — to generate Reports covering estimated market price, price forecasts, safety scores, infrastructure quality, demographics, and related neighborhood insights for properties you search.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business use. Some features require registration and, for Premium Subscriptions, payment of applicable fees. We may add, modify, or discontinue features of the Services at any time, as described in Section 10.

PLEASE READ THIS SECTION CAREFULLY. REPORTS ARE GENERATED USING AUTOMATED, AI-DRIVEN ANALYSIS OF THIRD-PARTY DATA AND ARE PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY.

Price estimates, price forecasts, safety scores, infrastructure ratings, and all other Report content are statistical estimates and predictions. They are not appraisals, valuations, surveys, or guarantees of any kind, and actual market conditions, prices, safety, or infrastructure quality may differ materially from what a Report indicates.

Reports do not constitute, and should not be relied upon as, financial advice, investment advice, legal advice, real estate brokerage advice, or a substitute for professional inspection, appraisal, title search, or legal due diligence. Before making any decision to purchase, sell, finance, or invest in a property, you should independently verify all information and consult qualified professionals, including a licensed real estate agent, appraiser, inspector, and legal counsel.

Third-Party Data may be incomplete, outdated, or inaccurate, as it is sourced from public records and third-party providers that we do not control and cannot independently verify in every case. HomeThingy disclaims any obligation to update Reports to reflect subsequent changes in the underlying data.

To access certain features, you must register for an account. You agree to (a) provide accurate, current, and complete registration information, and (b) promptly update such information to keep it accurate. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@homethingy.com if you suspect unauthorized use of your account.

You agree not to: (a) create an account using false information or impersonate another person; (b) share your account credentials with third parties; (c) use the Services to build a competing product; (d) reverse engineer, decompile, or attempt to extract the source code or underlying models of the Services; (e) use bots, scrapers, or automated tools to systematically extract Report data; (f) circumvent usage limits on the Free Tier; or (g) use the Services for any unlawful purpose.

In connection with your use of the Services, you must not: post or transmit content that is unlawful, threatening, harassing, defamatory, or infringes any third party's intellectual property or privacy rights; upload viruses or malicious code; interfere with or disrupt the Services or servers; harvest data about other Users; use the Services for any commercial resale of Report data without our written consent; or attempt to gain unauthorized access to any portion of the Services, other accounts, or related systems.

The Services may connect you with independent real estate agents, inspectors, lenders, or other service providers ("Partners"). Any engagement, transaction, or agreement you enter into with a Partner is solely between you and that Partner. HomeThingy does not vet, endorse, employ, or guarantee the work of any Partner and is not a party to, and bears no liability for, any dealings between you and a Partner.

We reserve the right to modify, suspend, or discontinue any part of the Services, including specific Report features or data sources, at any time, with or without notice. We do not guarantee uninterrupted or error-free access to the Services and will not be liable for any loss resulting from downtime, maintenance, or discontinuation of any feature.

You may close your account at any time by contacting support@homethingy.com. We may suspend or terminate your account, in our sole discretion, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason, with or without notice. Sections 5, 8, 12, 13, 14, and 15 survive termination of your account or these Terms.

The Services, including all software, algorithms, design, text, graphics, the HomeThingy name and logo, and all Report formatting and presentation (excluding Third-Party Data itself), are the property of HomeThingy or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works based on the Services without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, revocable license to download or print individual Reports for your personal, non-commercial use. Systematic reproduction, resale, or redistribution of Reports or underlying data is prohibited without our prior written consent.

THE SERVICES AND ALL REPORTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. HOMETHINGY DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY REPORT, PRICE ESTIMATE, FORECAST, OR SAFETY SCORE.

You agree to defend, indemnify, and hold harmless HomeThingy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (a) your breach of these Terms, (b) your use of the Services or reliance on any Report, or (c) any decision you make regarding a property based, in whole or in part, on the Services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMETHINGY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY — INCLUDING LOSSES ARISING FROM A PROPERTY PURCHASE, SALE, OR INVESTMENT DECISION MADE IN RELIANCE ON A REPORT — ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF HOMETHINGY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

HOMETHINGY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO HOMETHINGY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 5,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law.

These Terms are governed by the laws of India, without regard to its conflict of law principles. Subject to the arbitration provision below, the courts of competent jurisdiction at Bengaluru, Karnataka will have exclusive jurisdiction over any dispute not subject to arbitration.

Any dispute, controversy, or claim arising out of or relating to these Terms, including its formation, interpretation, breach, or termination, will first be addressed through good-faith negotiation. If not resolved within 30 days, the dispute will be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, and any statutory amendments thereto. The arbitration will be conducted by a sole arbitrator appointed by mutual agreement of the parties, the seat and venue of arbitration will be Bengaluru, Karnataka, India, and the proceedings will be conducted in English. The arbitral award will be final and binding on the parties. Nothing in this Section prevents either party from seeking interim injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

Any User Content you submit (such as saved searches, reviews, or feedback) grants HomeThingy a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content in connection with operating and improving the Services. Any suggestions or feedback you provide about the Services become the property of HomeThingy, and we may use them without obligation to you.

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the name and contact details of the Grievance Officer are provided below. The Grievance Officer will acknowledge complaints within 24 hours and endeavor to resolve them within 15 days of receipt, as required under applicable law.

If you believe content available through the Services infringes your copyright, please send a written notice to enquiry@thoughtverve.com identifying the copyrighted work, the material you believe is infringing, and your contact information. We will review and respond to valid notices in accordance with applicable law.

The Services rely on third-party data providers and cloud infrastructure to generate Reports. We do not control, and are not responsible for, the accuracy, availability, or performance of Third-Party Data or infrastructure, and disclaim liability for any interruption or error attributable to such third parties.
